Bagi pembeli pertama, ini bisa sangat membingungkan. Panduan ini menjelaskan perbedaan setiap jenis dokumen secara lengkap sehingga Anda bisa membuat keputusan dengan lebih percaya diri.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SHM (Sertifikat Hak Milik) \u2014 Kepemilikan Tertinggi<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">SHM adalah bentuk kepemilikan properti paling kuat di Indonesia. Pemilik SHM memiliki hak penuh atas tanah dan bangunan tanpa batas waktu. Tidak ada kewajiban perpanjangan, tidak ada pihak ketiga yang bisa mengklaim tanah Anda selama Anda memiliki SHM yang sah.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Keunggulan SHM<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Kepemilikan permanen<\/strong> \u2014 berlaku seumur hidup dan bisa diwariskan<\/li>\n<li><strong>Nilai jual tertinggi<\/strong> \u2014 properti SHM secara konsisten dihargai lebih tinggi di pasar<\/li>\n<li><strong>Jaminan KPR terbaik<\/strong> \u2014 bank lebih mudah memberikan pinjaman dengan SHM sebagai agunan<\/li>\n<li><strong>Bisa ditingkatkan<\/strong> \u2014 HGB dan hak lain bisa dikonversi ke SHM<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Siapa yang Bisa Memiliki SHM?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Hanya Warga Negara Indonesia (WNI) yang bisa memiliki properti dengan status SHM. WNA tidak bisa memiliki SHM secara langsung \u2014 mereka hanya bisa melalui HGB atau skema lainnya.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">HGB (Hak Guna Bangunan) \u2014 Aman tapi Berjangka Waktu<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">HGB memberikan hak untuk menggunakan dan mendirikan bangunan di atas tanah, tetapi dengan batas waktu. Umumnya HGB diberikan selama 20\u201330 tahun dan bisa diperpanjang 20 tahun, kemudian diperbarui kembali.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Karakteristik HGB<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Batas waktu:<\/strong> biasanya 20\u201330 tahun pertama, bisa diperpanjang<\/li>\n<li><strong>Siapa yang memiliki:<\/strong> WNI dan badan hukum Indonesia (PT, CV, koperasi)<\/li>\n<li><strong>Penggunaan umum:<\/strong> apartemen, ruko, kawasan perumahan developer, properti komersial<\/li>\n<li><strong>Jaminan bank:<\/strong> bisa dijadikan agunan KPR, meski kadang bunga sedikit lebih tinggi<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Proses Perpanjangan HGB<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">HGB yang hampir habis masa berlakunya harus diperpanjang sebelum expired. Proses perpanjangan dilakukan di BPN setempat. Jika HGB dibiarkan expired, status tanah kembali ke negara. Sebelum membeli properti HGB, pastikan masa berlakunya masih panjang (minimal 15\u201320 tahun ke depan) atau developer menjamin perpanjangan.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">HGB bisa Ditingkatkan ke SHM<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Jika Anda membeli properti HGB untuk hunian pribadi, Anda bisa mengajukan peningkatan hak menjadi SHM ke BPN. Prosesnya memakan waktu 3\u20136 bulan dengan biaya bervariasi tergantung luas dan lokasi properti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">AJB (Akta Jual Beli) \u2014 Bukti Transaksi, Bukan Sertifikat<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">AJB sering disalahpahami sebagai setara dengan sertifikat. Padahal AJB hanyalah <strong>bukti telah terjadinya transaksi jual beli<\/strong>, bukan bukti kepemilikan yang kuat seperti SHM atau HGB.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">AJB dibuat dan ditandatangani di hadapan PPAT (Pejabat Pembuat Akta Tanah). AJB wajib ada dalam setiap transaksi properti sebagai bukti formal perpindahan hak, namun harus diikuti proses balik nama sertifikat di BPN.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Risiko Jika Hanya Memegang AJB Tanpa Sertifikat<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Tidak bisa dijadikan jaminan KPR di bank<\/li>\n<li>Rentan sengketa jika penjual menjual ke pihak lain sebelum balik nama selesai<\/li>\n<li>Nilai properti lebih rendah di pasaran<\/li>\n<li>Proses balik nama berikutnya bisa rumit jika ada perubahan kepemilikan<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Rekomendasi:<\/strong> Segera proses balik nama sertifikat ke nama Anda setelah AJB ditandatangani. Jangan tunda prosesnya.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">PPJB (Perjanjian Pengikatan Jual Beli) \u2014 Pra-Akad<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">PPJB adalah perjanjian yang dibuat sebelum AJB, biasanya digunakan ketika:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Properti masih dalam proses pembangunan (inden)<\/li>\n<li>Dokumen belum lengkap (sertifikat masih proses di BPN)<\/li>\n<li>KPR pembeli masih dalam proses persetujuan bank<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">PPJB mengikat kedua belah pihak secara hukum dan biasanya mencantumkan: harga, jadwal pembayaran, kondisi yang harus dipenuhi sebelum AJB, dan klausul penalti jika salah satu pihak wanprestasi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SHSRS (Sertifikat Hak Satuan Rumah Susun) \u2014 untuk Apartemen<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">SHSRS adalah sertifikat kepemilikan untuk unit apartemen atau rumah susun.
